The Federal High Court sitting in Abuja has struck out an ex-parte application filed by the convicted leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, seeking his transfer from the Sokoto Correctional Facility.
Justice James Omotosho dismissed the application during proceedings on Tuesday following the withdrawal of Kanu’s legal representation from the matter.
At the hearing, Kanu’s counsel, Mr. Demdoo Asan, a senior legal officer with the Legal Aid Council of Nigeria, informed the court of his intention to withdraw from the case, citing irreconcilable differences between his office and the applicant’s family.
Asan explained that since the last adjourned date, he had maintained constant telephone communication with members of Kanu’s family regarding the application.
However, he told the court that despite several assurances and repeated phone calls, the family failed to appear at the Legal Aid Council office to formally withdraw the application.
According to him, the continued absence of the applicant’s family made it impossible for the Legal Aid Council to proceed effectively with the matter.
In his ruling, Justice Omotosho granted the request of Asan and the Legal Aid Council to withdraw from representing Nnamdi Kanu. Consequently, the court struck out the ex-parte motion seeking Kanu’s transfer from the Sokoto Correctional Facility.
The case was thereafter adjourned, pending further action by the defendant with new legal representation.
